Rules

 1. SUBJECT MATTER OF THE CONTRACT

1.1. Registration of the user on the official web page of “Barami Logistics” Company www.Barami.us is free and voluntary. After registration the user is conferred an individual number fixed in a common commercial invoice accompanying the freight, customs documentation and the Company database.
User himself/herself accounts for keeping his/her own registration data confidential and himself/herself controls all operations conducted with use of his/her data by any third person. Contact information indicated by the user during registration is confidential, except the case when the law requires disclosure of such information or its transfer by any other form;
1.2. This Contract regulates relations between the Parties originated in the course of transportation of the Orderer’s freight by the Forwarder and forwarding service. The Company ensures forwarding transportation to Georgia of the freight sent by the Orderer and received by the Forwarder, also internet shopping and rendering any other service in its name, at the user’s expense.

 2. TRANSPORTATION COST, ROUNDING OF PARCEL WEIGHT AND PAYMENT

2.1. Air transportation

2.1.1. Transportation cost is calculated by real parcel weight, except the cases when parcel weight and size exceed parcel typical sizes and weight. User, by means of the calculator given on the official site of the Company, is obliged to calculate the cost of parcel (freight) transportation, as transportation rate for all parcels is individual, calculator is the only means to establish the rate of transportation;
2.1.2. Weight is rounded with 100-gram accuracy, minimal weight - 0.2 kg;
2.1.3. If freight weight exceeds 30 kg, it does not fall into “a parcel” category, and its transportation rate is calculated with consideration of the volume sizes;
2.1.4. If parcel length/width/height exceeds 60 cm or 30 kg, the rate is calculated based on its nonstandard sizes. Please, calculate the cost in advance, by means of the calculator. Please, mind, as the Company, by means of the calculator placed on the site enables preliminary receipt of information on the rate, no claim concerning already reflected indebtedness will be received and be subject to appeal;
2.1.3. Settlement between the Parties is made at any stage of freight transportation. Taking out of the unpaid parcel by the User is inadmissible;  
2.2. Sea transportation
2.2.1. User, by means of the calculator given on the official site of the Company, is obliged to calculate the cost of parcel (freight) transportation, as transportation rate for all parcels is individual, calculator is the only means to establish the rate of transportation.

 

3. SERVICE OF REDUCTION OF PARCEL IN SIZE

3.1. Repacking service, that is to say reduction of parcel in size, takes place in automatic mode;
3.2. Several parcels arrived by one tracking can be united in one box. Parcels existing under different tracking numbers are not united;
3.3. Contents of a parcel can be taken out in a bag;
3.4. If a parcel, by the store or manufacturer, has a special belt showing us that the item is fragile, in this case the Company does not repack the parcel and accordingly, the store accounts for the packing.


4. TRANSFER OF PARCEL TO THE THIRD PERSON   

4.1. Parcel is given to the third person in case the person holds the following information:
1) Tracking number, fully, and telephone number of the recipient;
If the third person submits the following documents:
1)     Document establishing identity of the recipient  (ID card, passport or driving licence);
2)     Document establishing his/her identity (ID card, passport or driving licence).

 

5. PARCEL SHIPPING AND RECEIPT PERIOD 

5.1. Duration of transportation makes up approximately 5-7 business days after shipment of the freight. User can receive information on tracking status in a personal cabinet.

 6. AUTOMATIC INSURANCE AGAINST LOSS AND DISAPPEARANCE

6.1. Any parcel tracking number of which is fixed as received at the branch of Barami Company is automatically insured;
6.2. Automatic insurance implies reimbursement according to weight in case of loss or disappearance of a parcel. Minimal fixed - 10 GEL / 1 kg - 10 GEL;
6.3. Lost/disappeared is considered to be any parcel fixed as received in the Company system, though, has not been received by the User within a reasonable period.
After the Recipient by any communication medium declares non-receipt of a parcel, the Company undertakes to provide the User with the exhausting information on a parcel status (location) within 5 working days. In case the Company fails to provide information and find a parcel, the parcel will be declared lost. Company, within 5 working days, is obliged to reimburse the sum of the item that is stipulated by the above mentioned conditions.

 

7. PREMIUM INSURANCE; CONDITIONS

7.1. Type 1:

Insurance against loss - 3 % of the cost indicated by the User. Minimal - 2.5 GEL.
  • Activation of insurance against loss is possible on all type parcels;
  • Only the item with indicated tracking number and cost is insured - amount and unit price existing in a parcel are not verified;
  • Revocation of insurance or repayment of the paid cost are not possible;
  • Insurance cost shall be covered immediately, upon ticking off the insurance, otherwise a parcel is not insured;
  • After receipt of information on loss of the parcel the Company, at the latest within 5 working days,  including the day of receipt of information, is obliged to provide the User with precise information on the parcel status;
  • In case of loss of the insured parcel, within 5 working days after receipt of the application the cost of the item will be transferred to the User on the personal balance of www.barami.us On the basis of request it is possible to transfer the sum from the balance to the bank account;
  • Only parcels fixed in the personal cabinet of the User of WWW.BARAMI.US and declared as lost are subject to reimbursement;
  • Activation of insurance against loss is possible at any moment of transportation.

7.2. Type 2:

Insurance against damage - 6 % of the cost indicated by the User, minimal - 6 GEL;
  • Activation of insurance against damage is possible only for online purchased parcels. Secondary parcels are not insured;
  • Only the item with indicated tracking number and packing is insured;
  • Insurance against damage implies only physical (visual) insurance of a parcel;
  • Revocation of insurance or repayment of the paid cost are not possible;
  • Insurance cost shall be covered immediately, upon ticking off the insurance, otherwise a parcel is not insured;
  • After declaration of damage of the parcel the Company, at the latest within 5 working days, including the day of receipt of information, is obliged to examine the issue of the parcel damage. During this period the User is not entitled to take out the parcel from the branch;
  • In case of fixing damage of the insured parcel, within 5 hours the cost of the item will be transferred to the User on the personal balance of www.barami.ge. On the basis of request it is possible to transfer the sum from the balance to the bank account;
  • Damaged item passes into the ownership of the Company;
  • Only parcels, fixed in the personal cabinet of the User of WWW.BARAMI.US and insurance cost of which is paid, are subject to reimbursement;
  • Activation of insurance against damage is possible at any moment of transportation.
User shall declare damage of the item upon receipt of the parcel, no claim, received after taking out the item from the office, will be examined;
7.3.  “Barami Logistics” Company does not take the responsibility for damage of the item sent from Georgia to the United States of America with return label, accordingly such parcels are not insured against damage;
7.4. “Barami Logistics” Company does not take the responsibility for loss of the item sent from Georgia to the United States of America with return label, accordingly such parcels are not insured against loss.

 

8. CUSTOMS CLEARANCE

8.1. User, from the day of receipt of the parcel at the US warehouse, is obliged to fill in a preliminary declaration data from the personal cabinet, if declaration is deleted by the User due to incorrect declaration, it is necessary to replace it with a new declaration, in the other case the parcel will undergo customs procedures by the primary declaration;
8.2. Company will assist the User to undergo the customs procedures, declare the goods and calculate the duty, though, the User accounts for accuracy of information submitted for customs clearance procedure;
8.3. In case Customs service or Ministry of finance inflicts a penalty, “Barami Logistics” Company, due to non-fulfilment of service conditions by the User, in whole or in part (e.g. incomplete or inaccurate declaration of the products), the Company reserves right to inflict payment of the mentioned fine on the User;
With consideration of the tax code of Georgia, a natural person can bring in a parcel at the cost of cost up to 300 GEL without any customs clearance.
According to the legislation of Georgia a product at the cost of 300 GEL or more, also freight with weight of 30 kg or more and uniform goods are subject to customs clearance.
Items, shopped from one and the same site, if their total cost is equal to or exceeds 300 GEL, are subject to customs clearance.
 

9. COURIER SERVICE

9.1. “Barami Logistics” Company offers the User 2 kinds of courier service: free and urgent;
9.2. Free courier service operates only on the scale of Tbilisi and Rustavi and implies delivery of the item at the address within 48 hours (2 working days), after the parcel is ready for taking at the address. After refusal of free courier service the User has no opportunity to make use of the mentioned service;
9.3. Quick courier service implies delivery of the item at the address on the scale of Tbilisi and Rustavi during 24 hours (1 working day). Cost of the mentioned service is defined by 3 GEL;
9.4. Quick courier service on the scale of Georgia implies delivery of the item within 3 working days. Cost of the mentioned service is defined by 10 GEL.
 

10. DELIVERY AND ACCEPTANCE

10.1. User, after receipt of the parcel, is obliged to check the contents of the parcel, in case of doubt about weight of the parcel, the application shall be fixed straight at the branch, in the presence of the Company representative, no claim will be examined after leaving the branch and the Company does not take the responsibility.

 

ARTICLE 319. FREEDOM OF CONTRACT. OBLIGATION TO ENTER INTO THE CONTRACT

1.     Private law entities, within legal boundaries, can freely enter into the contracts and define the contents of these contracts. They can also enter into such contracts which are not stipulated by the law, but do not contradict it. If for observation of the essential interests of a company or a person the authenticity of the contract depends on the permit of the state, then this shall be regulated by a separate law;

2.     If any Party to the Contract holds a dominated position on the market, then, in this sphere of activity it is placed obligation to enter into the Contract. It cannot groundlessly offer the counteragent the unequal conditions of the contract;

3.     Persons, who for non-entrepreneurial objectives or for satisfaction of the subsistence demands purchase or use the property or service, groundlessly cannot be refused entering into the Contract, if the other Party to the Contract operates within the frames of its entrepreneurial activity.

 

11. OTHER ADDITIONAL CONDITIONS

1. Barami Logistics reserves right to modify this Contract and notify this to the User, information on any modification will be placed on the web page;

2. Company does not take the responsibility for any delay due to any reasons beyond its control, force-majeure of air flights and/or overload due to holidays, information on this is provided to the User by means of the personal cabinet.

 

12. TERMINATION OF CONTRACT/SERVICE

Aggressive type action expressed towards the Company, insulting expressions and spreading of unspecified information purposefully damaging the Company image and acting against the Company interests, stipulate termination of service, revocation and blocking of cabinet.

13. SMS/Email Notifications

Barami reserves the right to use the customer's email address and phone number to share marketing or/and informational messages related to its products and/or services. If the client does not want to receive direct marketing or/and informational messages, he can unsubscribe from his personal account by clicking on the "Unsubscribe" button, where he will receive the corresponding message by clicking on the cancellation.
